Expertise

Fabien is a senior IP lawyer who advises on all aspects of trade mark law, including clearance, prosecution, opposition proceedings and enforcement, as well as broader brand protection strategies.

While his core expertise lies in intellectual property strategy and disputes, his practice also extends to broader advisory work, including IP commercialisation, contractual risk allocation, corporate due diligence and litigation management.

Fabien works closely with his clients and is genuinely invested in their brands, protecting and defending their IP rights with the same care and attention as if they were his own. He likes keeping things simple for clients, distilling complex issues into clear, practical advice and delivering commercially focused solutions.

Before joining Cornwalls, Fabien spent nearly eight years in the IP group of a leading commercial firm, advising major Australian and international clients across a broad range of sectors including fashion, luxury, healthcare, pharmaceuticals, technology, construction, and food and beverage.

Experience

Fabien’s recent experience includes:

  • Advising on intellectual property strategy within wider commercial operations, including manufacturing, distribution, licensing and service arrangements;
  • Drafting and negotiating commercial agreements incorporating IP elements, including licence
    agreements, assignments, coexistence agreements and settlement deeds;
  • Supporting corporate transactions through IP due diligence and legal/commercial risk analysis;
  • Handling disputes and litigation in connection particularly in relation to trade marks, passing off, misleading or deceptive conduct, copyright, designs, including opposition and non-use actions in Australia and foreign jurisdictions;
  • Coordinating cross-border brand enforcement and management projects, liaising with foreign counsels, investigators and internal business & legal teams;
  • Designing and overseeing anti-counterfeiting enforcement initiatives involving investigations, seizure actions and negotiated resolutions; and
  • Advising on european semi-governmental bodies on geographical indications related issues.

Qualifications

  • Completion of Priestley 11 requirements via Juris Doctor program (University of Melbourne)
  • Master of law, majoring in International Business Law (Sorbonne University, France)
  • Master of Law, majoring in Wine & Spirits Law (University of Champagne, France)
